Father’s Rights

Fathers’ Rights Lawyer in St. Paul

As a father, there are many scenarios where you could want to establish your parental rights. If you are a father out of wedlock or if you are a father looking to secure custody and visitation, then you need to make sure you have the proper representation to help you navigate the law. Minnesota law automatically gives the mother custody with a child that was born out of wedlock. If you have a child that was born while you were married, then there is no preference to gender by the court system. This means there is an opportunity to secure the rights you are looking for.

If you are dealing with a child custody matter, it is important that you consult with a family law attorney. When working with our law firm, you will have an experienced attorney who is easily accessible, patient, tech savvy and efficient so that you can save on attorney costs. We offer free consultations to help you determine what your next steps need to be.

What Does Fathers’ Rights Mean?

There is a role for both the mother and the father in the lives of their children. A child also benefits from having their mother and father in their lives. Minnesota law historically has favored mothers in the custody battle, but that is not currently the case. The court system in Minnesota cannot make a determination based on gender alone. Father’s have just as many rights as the mothers’ do in child custody. Because of this, it is important that you have an experienced family law attorney to help you navigate these nuances.

What Legal Rights Do Unmarried Fathers Have In Minnesota?

If the father is unmarried and has a child, then they have no legal rights to custody until paternity is established. At that point, the father will be considered a legal parent and will have the right to petition the court for custody and visitation rights. If paternity is established for the father and they do not have custody of the child, then the father will become responsible for child support.
